These Terms and Conditions (“Terms”) govern the use of jkblandworks.com (the “Website”) and all forestry and land management services provided by JKB Land Works (“Company,” “we,” “us,” or “our”), an Ohio-based forestry services business.

By accessing this Website or engaging our services, you agree to be bound by these Terms.

1. Services Provided

 

JKB Land Works provides forestry and land management services in the State of Ohio, including but not limited to:

  • Tree cutting and removal

  • Land clearing

  • Brush control

  • Site preparation

  • Forestry maintenance services

  • Equipment operation

We do not engage in timber sales contracts or purchase standing timber from landowners.

All services are subject to site inspection and written approval or estimate.

2. Estimates and Scope of Work

  • Written estimates are valid for 30 days, unless otherwise stated.

  • Estimates are based on visible and reasonably discoverable site conditions at the time of inspection.

  • Additional charges may apply if unforeseen conditions are encountered, including but not limited to:

    • Buried debris

    • Unstable or saturated soil

    • Rock formations

    • Hidden utilities

    • Environmental hazards

Any changes to the scope of work must be agreed to in writing.

3. Property Owner Responsibilities

 

The Client agrees to:

  • Clearly identify property boundaries

  • Mark or disclose underground utilities, septic systems, irrigation systems, or private lines

  • Obtain required permits unless otherwise agreed

  • Provide safe and reasonable access to the property

  • Secure pets, livestock, and personal property

JKB Land Works is not responsible for damage to unmarked underground utilities, concealed structures, or improperly identified boundaries.

4. Subcontractors

 

We may engage qualified subcontractors to perform certain portions of the work. All subcontractors are expected to operate in compliance with applicable Ohio laws and safety standards.

JKB Land Works remains responsible for coordinating and overseeing subcontracted work.

5. Inherent Risks of Forestry Operations

 

Forestry and land clearing activities involve inherent risks, including but not limited to:

  • Falling trees and debris

  • Ground disturbance and soil rutting

  • Equipment tracks or surface damage

  • Weather-related delays

  • Noise and dust

By hiring our services, the Client acknowledges and accepts these inherent operational risks.

6. Payment Terms

​

  • No deposit is required unless otherwise stated in writing.

  • Payment is due upon completion of services unless otherwise agreed in writing.

  • Invoices not paid within [Insert Number] days may incur late fees as permitted under Ohio law.

  • We reserve the right to pursue collection remedies allowed under Ohio law for unpaid balances.

7. Insurance and Limitation of Liability

 

JKB Land Works maintains commercially reasonable insurance coverage for its operations.

To the fullest extent permitted under Ohio law:

  • We are not liable for indirect, incidental, special, or consequential damages.

  • Our total liability for any claim arising out of services provided shall not exceed the amount paid for the specific services giving rise to the claim.

Clients are encouraged to notify their property insurance carrier prior to major land clearing operations.

8. Force Majeure

 

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including but not limited to:

  • Severe weather

  • Flooding

  • Acts of God

  • Government restrictions

  • Equipment breakdown

  • Labor shortages

9. Website Use and Intellectual Property


All content on jkblandworks.com, including text, images, logos, and graphics, is the property of JK Bland Works and may not be copied, reproduced, or distributed without written permission.

Users agree not to interfere with or disrupt the Website’s functionality.

10. Governing Law and Dispute Resolution

 

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio.

Any legal action arising out of these Terms or our services shall be brought in a court of competent jurisdiction located in [Insert County], Ohio.
